Terms and Conditions of Sale

These Terms and Conditions of Sale apply to reservations and purchases made through the kupee.ee website. By submitting a reservation, the customer confirms that they have read and agree to these terms and conditions.

Kupee OÜ is not subject to value-added tax, so no VAT is added to the prices.

2. Prices

All prices displayed on the website are in euros and are final. The cost of a reservation depends on the selected compartment (or reservation for the entire train), the dates of travel, and any additional services selected. The applicable price is displayed to the customer before the reservation is confirmed and paid for.

3. Products and Services Offered

You can book and purchase through kupee.ee:

• accommodation in one of four train compartments;
• a reservation for the entire train;
• gift cards.

In the future, additional features will include late check-out, a pet fee, breakfast and dinner ordering, a snack vending machine with online payment, and recreational services (e.g., a hot tub and shuttle service). The products and services available at any given time, along with their prices, are listed on the website.

4. Making a Reservation and Placing an Order

To make a reservation, follow these steps:

1. The customer selects the desired compartment (or the entire train) on the website, along with the dates of travel and any additional services they wish to book.
2. The customer enters the contact information required for the reservation.
3. The customer reviews these terms and conditions of sale and confirms their agreement to them (checkbox).
4. The customer pays for the reservation online.
5. Once payment has been received, Kupee OÜ will send the customer a booking confirmation.

The contract is considered concluded once payment for the reservation has been made and a confirmation has been issued.

5. Payment and Payment Methods

You can pay for your reservation using the following payment methods.

Online Payments. You can pay on the website using bank links and credit/debit cards. Payments are processed by Maksekeskus AS (trademark MakeCommerce), registration code 12268475, address Liivalaia 45, Tallinn 10145, Estonia. In addition, card payments are processed via Stripe (WooPayments). Online payments are processed outside the kupee.ee environment in the payment service provider’s secure payment environment, and Kupee OÜ does not have access to the customer’s bank or card information.

Cash payment. Cash payments can be made on site as follows:

• At the Kupee location (1a Kesk Street, Mõisaküla) — for reservations totaling more than 200 €;
• At Castle Escape (Lossi 42, Viljandi) — regardless of the booking amount (whether under or over 200 €).

6. Access to the Service and Provision of Accommodation

Accommodations are self-check-in, and staff are not required to be present.

• Check-in: starting at 2:00 p.m. Early check-in is possible by arrangement and subject to availability.
• Check-out: by 12:00 p.m. Late check-out is available for an additional fee, subject to availability.
• Once payment has been received, the customer will receive a booking confirmation and the door PIN via email and/or text message.
• The PIN code is valid for the entire duration of the reservation—from the check-in time until the check-out time.

The gift card will be sent to the customer via email and is valid until the expiration date indicated on the gift card.

7. Cancellation of Reservations and Refunds

The following terms and conditions apply to reservation cancellations:

• More than 72 hours before arrival: If you cancel your reservation, you will receive a 100% refund of the amount paid.
• 24–72 hours before arrival: 80% of the amount paid will be refunded.
• Less than 24 hours before arrival or no-show: no refund.

Reason for the cancellation policy: When a reservation is made, we reserve the compartment exclusively for the customer, and the automated system pre-sets the room temperature and other conditions necessary for the customer’s arrival. This incurs costs, which is why the cancellation and refund policies listed above apply.

The refundable amount will be credited back to the same payment method used for the original payment no later than 14 days after the cancellation. Refunds are processed by Maksekeskus AS.

Right of Withdrawal: Pursuant to Section 53(4)(7) of the Law of Obligations Act, the consumer’s 14-day right of withdrawal does not apply to accommodation services tied to a specific date or period. Cancellation of a reservation is subject to the conditions set forth in this section.

8. Accommodation Rules and Liability

The guest agrees to use the accommodations in a responsible manner and is liable for any damage caused by the guest or the guest’s companions. Smoking is prohibited on the premises. Kupee OÜ is not liable for the guest’s personal belongings or for any damage caused by the guest.

9. Processing of Personal Data

Kupee OÜ processes customers’ personal data to fulfill reservations and comply with legal obligations. More detailed information regarding the processing and storage of personal data, as well as customers’ rights, is provided in the privacy policy.

10. Dispute Resolution

These terms and conditions are governed by the laws of the Republic of Estonia. Disputes shall be resolved through negotiation. If no agreement is reached, the consumer has the right to turn to the Consumer Disputes Committee of the Consumer Protection and Technical Regulatory Authority (tarbijakaitse.ee) or use the European Union’s Online Dispute Resolution (ODR) platform.

11. Acceptance of the Terms and Conditions

Before making a payment, the customer can review these terms and conditions of sale and confirm their agreement by checking the box. The reservation cannot be completed without agreeing to the terms and conditions.
